LEARNED HAND
The distinguished jurist signs a typed letter in 1951, the year he attained "senior status."
Typed Letter signed: "Learned Hand" as Circuit Court Judge, 1 page, 8½x11. New York, N.Y., 1951 March 22. On letterhead of Judge Learned Hand's Chambers, US Court House, New York, to Robert McNiel, Roanoke, Virginia. In full: "I have your letter of the 20th and it gives me great pleasure to acknowledge it, as you ask me to do, by writing a letter signed by myself. Sincerely yours". Accompanied by original mailing envelope (9½x4). Learned Hand (1872-1961) received his law degree from Harvard in 1896. He was a Judge of the U.S. District Court for New York's Southern District (1909-1924) and of the Federal Second Circuit Court of Appeals (1924-1951). He never served on the Supreme Court but was often called the "tenth Justice of the Supreme Court", and was regarded as one of the finest jurists in American history. Hand delivered more than 2,000 opinions. He was noted especially as a defender of free speech and is regarded by many as the greatest judge never to be appointed to the Supreme Court. US federal judges may opt for "senior status" when they fulfill the requirements of the "Rule of 80": generally speaking, the sum of their age and length of service. Senior judges receive full salaries and continue to hear cases on a limited basis, but their seats are considered open and may be filled by new Presidential appointments. The exact requirements have changed several times, but when Hand opted for senior status, it meant 70 years of age plus 10 or more years on the federal bench. Obviously, Hand could have exercised this option nearly a decade before he did so. Mailing folds, not at signature. Fine condition.
