GABRIEL DUVALL and HADIJAH BAYLIES
The Comptroller cannot authorize payment related to fishing agreements.
Manuscript LS: "G. Duvall" as U.S. Comptroller of the Currency, 1p, 8x10. Treasury Department, Comptroller's Office, 1804 February 3. To Hadijah Baylies. In full: "I have received your letter of the 11 ultimo, enclosing two fishing Agreements for my consideration. I deem it sufficient to observe, that these agreements contain stipulations repugnant to the provisions of the fourth section of the Act concerning the fisheries; and that, therefore, it would exceed the limits of my powers to authorize you to pay the allowance claimed by the applicants. I return you the Agreements." Docket on verso in Baylies' hand indicates he returned the fishing agreement "to J. Bowers by David Burges the skipper of the Schr George to which it belonged." GABRIEL Duvall served as Associate Justice of the Supreme Court from 1811-1835, when he was compelled by deafness to resign. HADIJAH BAYLIES had served as an Aide-de-Camp to General George Washington during the Revolutionary War. Lightly creased. Nicked at edges at horizontal folds. Fine condition.
