Supreme Court decision relating to minority teachers retained while non-minority teachers with more seniority were laid off.
Printed Syllabus signed: "Lewis F. Powell, Jr.", 60p, 6x9. "Wygant et al v. Jackson Board of Education et al. Certiorari to the United States Court of Appeals for the Sixth Circuit No. 84-1340. Argued November 6, 1985 - Decided May 19, 1986". Certiorari is a writ issued to call up the records of an inferior court or remove a case there pending to a higher court. In part: "The collective-bargaining agreement between respondent Board of Education (Board), and a teachers' union provided that if it became necessary to lay off teachers, those with the most seniority would be retained, except that at no time would there be a greater percentage of minority personnel laid off than the current percentage of minority personnel employed at the time of the layoff...." During certain school years, non-minority teachers were laid off while minority teachers with less seniority were retained. The District Court upheld the constitutionality of the layoff provision, which was affirmed by the Court of Appeals. The Supreme Court, however, reversed the decision, with Justice Powell delivering the opinion of the Court. Powell, appointed by President Nixon in 1972, retired in 1987. Fine condition.
