In full: "A rule compelling the critic of official conduct to guarantee the truth of all his factual assertions ... leads to 'self-censorship.' ... We hold today that the Constitution delimits a State's power to award damages for libel in actions brought by public officials against critics of their official conduct." Quote is from the U.S. Supreme Court decision in New York Times v Sullivan (1964), in which Brennan wrote the decision for a unanimous Court. Reversing an award of damages for libel by an Alabama trial court in a suit brought by a Montgomery, Alabama Commissioner against four Black clergymen and the "New York Times" for an advertisement appearing in the "Times", the Supreme Court held that public officials may not sue for punitive damages for defamatory falsehood relating to their public duties and official conduct unless they can prove actual malice: "that the statement was made with...knowledge that it was false or with reckless disregard of whether it was false or not." Brennan (1906-1997), appointed by President Eisenhower, served as Associate Justice from 1956-1990. Mount is lightly creased at upper and lower right blank corners. 2 stray ink marks at lower right edge, light fingerprint stain at lower right margin. Fine condition.
