In full: "Replying to your letter of June 30 will say that I have
heard very little talk among senators as to the probability of the Newberry case
being brought before the Senate again. I understand from the newspapers that
Col. Brookhart of Iowa pledged himself to make an effort to have the Newberry
case reconsidered, if elected to the Senate. It is my understanding that the
question can be raised at any time any senator introduces a resolution. It will
require only a majority to declare the seat vacant. Very respectfully,"
Capper (1865-1951), a newspaper publisher and owner of two radio
stations, was Republican Governor of Kansas (1915-1919) and U.S. Senator
(1919-1949). In Newberry v. United States (1910), the Supreme Court had
ruled that the federal Corrupt Practices Act of 1910 did not apply to state
