Terms and Conditions of Sale

Representations & Guarantees

A purchase shall not be considered an "approval" sale. If any substantial defect not described in the listing is found by the purchaser, the item(s) must be returned within two days of receipt. Item(s) may not be returned except for reasons of authenticity or substantial defect in description (see "Condition" below for details). We warrant to the original purchaser for a period of ten (10) years from the date of the sale the authenticity of any item purchased. This warranty is limited to a refund of the purchase price upon the return of the merchandise to our parent company Gallery of History Inc. in satisfactory condition. Gallery of History Inc. is not liable for any other damages, including consequential damages. THERE ARE NO OTHER WARRANTIES OF ANY NATURE EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Authenticity

Each hand-signed document has been authenticated and is accompanied by a certificate of authenticity issued by our parent company Gallery of History Inc. The term of the COA is 10 years from date of purchase and is valid to the original purchaser only. We have an outstanding reputation for the thoroughness of our research, for our business integrity and for our service to our clients. Furthermore, we financially stand behind our COA which is one of the main reasons we've been able to stay in business for so long (since 1981)!

Condition

We have tried to accurately describe every item at History For Sale. If any substantial defect not described at History For Sale is discovered by the purchaser, the item(s) must be returned within two days of receipt. This is not an approval sale. Please call us for an authorization before returning the item(s). A merchandise credit will be issued in the case of an unresolved dispute over condition.

Make Offer Option

Following an offer submission, customers will be contacted via their HistoryForSale ("HFS") account email address. Our response will be to either accept your offer, decline your offer or send you a final counteroffer. All offers can be viewed from within the "Offer Review" area of your HFS account.

Any price discount that results of the "Make Offer" process cannot be combined with any other discounts or promotions (e.g. free shipping) and will be the final offer price for the item. During the Make an Offer process items will remain available to all users until a purchase has been made and payment received. Therefore, we suggest that users check their emails frequently for our response as purchase of a document is subject to its availability. Under certain circumstances offers may be cancelled prior to the offer expiration date and users may not always be notified of an offer status change.

Seller's Rights

Gallery of History Inc. reserves the right to withdraw any item from its History For Sale website, reject or exclude any party from purchasing at History For Sale for any reason it deems appropriate. Sole discretion in these matters rests with Gallery of History Inc. Decisions of Gallery of History Inc. are final. Prices are subject to change without notice.

This sale is being held in accordance with the laws of the State of Nevada, and any and all proceedings to enforce the terms and conditions of this sale will be brought in Clark County, Nevada.

All sales are final, but may be rejected by the Gallery of History Inc. for any reason it deems appropriate, at its sole discretion.

Use of Images & Descriptions

Gallery of History Inc. retains all rights to item images and item descriptions of every piece listed or sold through our website or other sales platforms. By purchasing an item, the buyer acknowledges and agrees that Gallery of History Inc. may continue to display, publish, and reproduce such images and descriptions for any purpose, including but not limited to marketing, archival reference, promotional use, or display in online or printed catalogs. These rights are perpetual, worldwide, royalty-free, and may be exercised in any media now known or hereafter developed.

Payment Methods

We accept and prefer as payment, PayPal, Visa, MasterCard and American Express. We typically do not except personal checks however if an exception is made, the merchandise will not be released until the funds have cleared through your bank account. Wire transfers are preferred for purchases exceeding $10,000 and will allow us to release the merchandise immediately upon receipt. Please call for bank wire transfer instructions when wishing to make payment by that method.

Payment Terms

Payment is due at that time of purchase. The purchaser is responsible for all shipping costs as well as any international customs duties and taxes.

Title of item(s) passes to the purchaser when payment in full has been received by the Gallery of History, Inc. There will be an additional charge of 15% of the check amount for a check that is returned to us by your bank. For any item(s) which has a substantial defect or authenticity dispute, the risk of loss shall remain with the purchaser until the item(s) is returned to and received by Gallery of History, Inc., which must take place within two (2) days of the receipt of the item(s) by the purchaser.

Shipping
  • No merchandise shall be shipped or delivered until payment in full is received.
  • All items will be shipped via either UPS or Federal Express unless otherwise noted.
  • In general, for the purchase of multiple, unframed, flat items in a given sale, a one-time flat fee will apply. Some excusions to this rule may exist.
  • Shipping fees include packaging, insurance and shipping charges.
Framing Options

All documents are being sold unframed unless otherwise specified.

THE PLACING OF AN ORDER SHALL CONSTITUE KNOWLEDGE OF AND ACCEPTANCE OF THE FOREGOING TERMS OF SALE.
