The Warner Bros. associate signs a typed memo regarding their
contract with DePatie-Freleng Enterprises in 1963.
Memorandum signed: "Howard", in blue ink. 1 page, 8½x11.
Warner Bros. Pictures, Burbank California, June 26, 1963. To "Dear
Hal" H.E. Holman, in full: "Enclosed herwith is one fully executed copy
of the June 20, 1963 letter agreement between Warner Bros. Pictures, Inc. and
De-Patie-Freleng Enterprises Unlimited, Inc. covering its assumption of
obligation under the June 14, 1963 Warner Bros./Filmways letter amendment
including, among other things, DePatie-Freleng's agreement to repay to us the
$10,000.00 paid by us, at DePatie-Freleng's request, to Filmways, Inc. pursuant
to the aforesaid Warner/Filmway's June 14, 1963 agreement. You already have in
your possession a check from Depatie-Freleng for %5,000.00 of this $10,000.00
sum. Effective June 24, 1963, and continuing for as long as there is an unpaid
balance of the remaining $5,000.00, please bill DePatie-Freleng an overhead rate
of twenty-five percent (25%)- rather than twenty percent (20%) for all permitted
uses of our facilities, services and equipment (other than those leased pursuant
to our May 6, 1963 letter agreement with DePatie-Freleng) as are utilized by
DePatie-Freleng in the production of television commercials or industrial films.
The moneys paid by DePatie-Freleng attributable to this five percent (5%)
increase in the overhead rate are to be applied to reduce the $5,000.00 loan
balance accordingly. Once this balance is completely paid, we will resume the
twenty percent (20%) rate in accordance with our May 6, 1963 rental agreement.
In any event, any portion of the $5,000.00 balance still unpaid as of May 12,
1964, will be paid to us by DePatie-Freleng withing three (3) days from such
date. (The Foregoing does not affect use of such facilities by DePatie-Freleng
for work other than television commercials or industrial films, which are to be
billed at our regular overhead rate, unless otherwise specifically advised). It
should be noted that, although we are not charging DePatie-Freleng any interest
on this outstanding balance of $5,000.00, we have obtained valuable
consideration for such advance. Bu advancing these moneys, we were able to
remove,--without cost to us--certain onerous restrictions previously imposed
under our February 22, 1960 contract with Filmways which prevented us from
renting our facilities and equipment to any third party for the production of
television commercials or industrial films." Howard Barton was an
associate with Warner Bros. Pictures during the 1960s. He worked at the company
after Warner Bros. closed its cartoon studios in 1963 when producers David H.
DePatie and Friz Freleng teamed up to form DePatie-Freleng Enterprises.
The company produced over 300 cartoons from 1964 until 1986. DePatie and
Freleng won the 1964 Academy Award for Short Subject (Cartoon) for The Pink
Phink. Pencil notes (unknown hand) at top margin. Paperclip impression
